Planning to hear from Kanne

FAIRPLAY, Colo. -- Villages at Sunset developer Larry Kanne will present oral arguments to the Park County Planning Commission on Jan. 13 supporting his request for an amendment to his Subdivision Improvement Agreement.

Kanne filed for Chapter 11 bankruptcy on Dec. 5, the date upon which he was to have filed a $2 million irrevocable letter of credit with Park County.

Park County Attorney Stephen Groome conferred with former County Attorney Robert Widner and attorney James Huemoeller, Widner's co-counsel who specializes in bankruptcy proceedings, on the matter. Groome was advised the bankruptcy proceeding tolled an automatic 60- day extension of Kanne's deadline with Park County.

"I expect Larry Kanne will be submitting a renegotiation plan," stated Groome who is also expecting further deadline requests from Kanne.

While the county's deadline has been automatically extended, Groome said the federal court cannot make Park County change the content of Kanne's SIA aside from the compliance date.

The BOCC will take up Kanne's request on Feb. 19.
