Elk Creek water diversion 1041 |
Ms. Hartman
I am a resident of Park County just adjacent to Jefferson County. Jefferson County should be concerned about their constituents downstream who are in danger of losing much of their water. Having been at the Park County hearings to date on the issue their have been no concerns as yet raised by Jefferson County and I know Park County will pay attention if Jefferson County raises the issue. There is a 1041 hearing to grant the taking of this water at 9:30 AM in Fairplay. I and your constituents (I know this after attending a meeting of 150 or so of your constituents last night) would much appreciate your attention to the issue. It is now also receiving media attention on Fox News.

Thank you for your concern in this matter. I have heard from many citizens on this, and appreciate your concern.
Our Planning staff, in consultation with our attorneys, are trying to determine whether Jefferson County has any legal ability to affect this decision. It is my understanding that the land owner has a water right issued in the State Water Court. We would have no authority to interfere with this. We also normally have no authority in another county's land use ( as they do not in our county.)
So, we are trying to identify what, if anything, we can do to influence this process. I will get back in touch with you as I learn more.
